General Terms & Conditions of Freight Forwarding
Standard Trading Conditions of Brosan Uluslararası Taşımacılık ve Dış Ticaret Ltd. Şti. (TİO-12489)
1. Preamble & Scope of Application
These General Terms and Conditions govern all quotation requests, freight rate estimates, bookings, and transportation management services executed via TurkeyFreightQuote.com and contracted with Brosan Uluslararası Taşımacılık ve Dış Ticaret Ltd. Şti. (hereinafter referred to as the "Forwarder" or "Company").
By submitting a Request for Quotation (RFQ) or accepting a formal freight offer, the customer, shipper, or consignee (the "Merchant") unconditionally accepts these terms as integral to the contract of carriage.
2. Quotation Validity & Spot Pricing
Unless explicitly confirmed in writing with a validity duration, all spot freight rates displayed or generated via digital tracking codes (e.g. TFQ-2026-XXXXX) are indicative and contingent on equipment availability, bunker adjustments (BAF/CAF/Fuel Surcharges), port terminal tariffs, and exchange rate fluctuations. Formal binding offers require formal written confirmation by the Forwarder's operations desk.
3. Carrier Liability & International Conventions
The liability of the Forwarder for loss, damage, or delay during transit is governed by mandatory statutory regimes:
- International Road Freight (CMR): Governed by the Convention on the Contract for the International Carriage of Goods by Road (CMR 1956/1978). Carrier liability is capped at 8.33 Special Drawing Rights (SDR) per gross kilogram of lost or damaged cargo.
- Ocean Container Freight: Governed by the Hague-Visby Rules or applicable ocean bill of lading conditions, capped at 666.67 SDR per package or 2 SDR per kilogram, whichever is higher.
- Air Freight: Governed by the Montreal Convention 1999, capped at 22 SDR per kilogram.
- Turkish Domestic Transport: Governed by the Turkish Commercial Code (Türk Ticaret Kanunu - TTK Law No. 6102).
Merchants are strongly advised to secure comprehensive All-Risks Marine Cargo Insurance covering 110% of the CIF shipment value.
4. Merchant Warranties & Cargo Packaging
The Merchant warrants that:
- All cargo descriptions, gross weights, carton dimensions, and hazardous classifications (ADR/IMDG/IATA DGR) declared during RFQ submission are 100% accurate.
- Goods are adequately packed, strapped, and secured to withstand the normal rigors of road, ocean, or air multimodal transport.
- All mandatory export and import documents (such as A.TR, EUR.1, commercial invoices, and export declarations) are provided prior to terminal cut-off times.
5. Demurrage, Detention & Waiting Times
Free time for truck loading and unloading in Turkey and destination countries is standardly 24 to 48 hours unless otherwise agreed. Demurrage for trailer waiting time beyond agreed free hours is billed at standard daily rates (€150–€250/day). Ocean container demurrage and detention charges follow carrier port tariffs once allowed free days (typically 7–14 days) lapse.
6. Jurisdiction and Applicable Law
These Terms and any disputes arising out of contracts between the Merchant and Brosan Lojistik shall be governed by and construed in accordance with the laws of the Republic of Turkey. The Courts and Execution Directorates of Istanbul (Çağlayan) shall have exclusive jurisdiction.
